Accordingly, this Privacy Policy is intended to provide guidance on how the personal information and data of individuals who visit the website and use its available features are collected, used, and otherwise processed. This document is one of the measures adopted under LMG’s Compliance Program with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados Pessoais – LGPD).

2. DEFINITIONS

PERSONAL DATA: Information relating to an identified or identifiable natural person. Information used to create the behavioral profile of a specific natural person is also considered personal data.

BRAZILIAN GENERAL DATA PROTECTION LAW (“LGPD”): Brazilian Law No. 13.709 of August 14, 2018, which governs the processing of personal data in digital or physical environments by natural persons or public or private legal entities. Its purpose is to protect data subjects while allowing data to be used for various purposes, balancing interests and harmonizing the protection of individuals with technological and economic development.

LMG CONTROL SYSTEM: A set of elements that, when operated in an integrated and dynamic manner, assists the organization in achieving its strategic objectives, mission, vision, and values. It guides the organization’s development and provides reasonable assurance that risks that could compromise its sustainability and growth are properly managed.

PERSONAL DATA SUBJECT (“DATA SUBJECT”): he natural person to whom the personal data being processed relates.

PROCESSING OF PERSONAL DATA (“PROCESSING”): Any operation performed on personal data, including collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of information, modification, communication, transfer, dissemination, or extraction.

3. SCOPE

This Policy establishes the circumstances under which personal data obtained from website visitors or users of restricted areas may be processed during their browsing activities, as well as the safeguards adopted by the organization regarding such data. Where applicable, the Brazilian General Data Protection Law (LGPD) and other national and international privacy and personal data protection regulations are used as references.

This Policy does not cover aspects, definitions, or guidelines relating to cookies, which are addressed in the Cookie Policy.

4. OBJECTIVES

The objectives of LMG’s Privacy Policy are:
I. To establish guidelines that ensure and reinforce the organization’s commitment to complying with applicable personal data protection laws;
II. To inform website visitors and users of restricted areas about how their information and personal data are processed when they visit and/or use restricted areas within LMG’s domains.

This Policy must be read together with the obligations set forth in the documents listed below, which address personal data protection and information security in general and supplement this Policy where applicable:
I. LMG Privacy and Personal Data Protection Policy, which provides guidance on how the organization must manage its various personal data processing activities and operations and establishes LMG’s strategy for safeguarding and using personal data processed in the course of its activities;

II. Cookie Policy, which seeks to provide users with transparency and an understanding of how their personal data may be processed through cookies during their interactions with LMG;

III. Information Security Policies and Procedures, as well as terms and conditions of use addressing the confidentiality, integrity, and availability of LMG’s information.

5. WHAT DATA WE USE

LMG may collect information actively provided by the User at the time of registration, as well as information collected automatically when the User accesses and uses the webpages and network, such as IP address identification and geolocation data.

Information provided by the User: LMG collects all information actively entered by the User on the website, such as name, email address, city, state, telephone number, and professional council registration number (CRM or CREFITO), when the User completes forms available on the webpages. LMG may use this information for advertising, training, recruitment, registration, and participation in trade shows and events, whether in person or online.

Data collected automatically: Subject to the User’s authorization, LMG also automatically collects information such as the characteristics of the access device and browser, IP address—including date and time—IP address origin, information about clicks, pages visited, pages subsequently accessed after leaving the website, and any search terms entered on or in connection with the website, among other information. For this purpose, LMG may use standard technologies such as cookies, pixel tags, beacons, and local shared objects. These technologies are used to improve the User’s browsing experience on the website according to their habits and preferences.

Users may disable the automatic collection of information through certain technologies, such as cookies and caches, by adjusting their internet browser settings or, specifically regarding cookies, through the settings available on our website. However, Users should be aware that disabling these technologies may prevent certain website features that rely on the processing of such data from functioning properly.

The information collected may be shared by LMG with its partner companies whenever necessary for the proper provision of services related to its business activities.

6. HOW WE USE THE DATA

The information collected by LMG is not intended to establish a contractual relationship, but solely to manage and improve the website, adapting it to Users’ preferences and interests, as well as to develop new services and products to be offered to Users.

The information collected may also be used for advertising purposes, such as sending information about trade shows and events promoted by LMG, subject to the Data Subject’s consent.

Legal Basis for Processing: In these cases, data processing is authorized pursuant to Article 7, items I, II, and V, of Law No. 13,709/2018, the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados – LGPD).

6.1. Compliance and Access to Personal Information

Only authorized employees may access LMG’s databases. Access to personal information is restricted and protected through best practices and strict compliance standards.

LMG undertakes not to sell, rent, share, or disclose your information to third parties without the Data Subject’s prior consent. The only exception applies when such information is required exclusively for purposes of public security, national defense, State security, or activities involving the investigation and prosecution of criminal offenses.

LMG undertakes to implement appropriate technical and administrative measures to protect personal data against unauthorized access and accidental or unlawful destruction, loss, alteration, disclosure, or dissemination, as well as to prevent damage resulting from the processing of personal data.

7. WITH WHOM WE SHARE DATA

LMG is an organization that works in partnership with several companies. Accordingly, it may share information collected through the webpages in the following circumstances:

  • With partner companies in connection with LMG’s business activities;
  • To protect LMG’s interests in any type of dispute, including legal proceedings;

8. HOW WE KEEP DATA SECURE

LMG stores the information collected through its website on its own servers or on servers operated by contracted service providers.

LMG uses reasonable industry-standard and legally required measures to preserve the privacy of the data collected through its website. Accordingly, it adopts the following precautions in compliance with the security standard guidelines established by Decree No. 8.771/2016:

  • LMG protects its systems against unauthorized access;
  • LMG grants access to the location where the collected information is stored only to previously authorized individuals;
  • Individuals who have access to the information are required to maintain strict confidentiality. Any breach of confidentiality may result in civil liability, and the responsible party will be held liable in accordance with Brazilian law; and
  • LMG maintains access records indicating the date and time, duration, identity of the employee or other person responsible for the access, and the file accessed, based on connection and application access logs, as required by Article 13 of Decree No. 8.771/2016.

LMG makes every reasonable effort to preserve the privacy of Users’ data. However, no website is completely secure, and LMG cannot guarantee that all information transmitted through the website will be fully protected against unauthorized access carried out using methods designed to obtain information unlawfully. For this reason, we encourage Users to take appropriate measures to protect themselves, such as keeping all usernames and passwords confidential.

9. RETENTION OF COLLECTED INFORMATION

Information collected by LMG through the website will be automatically deleted from its servers when it is no longer necessary for the purposes for which it was collected or when the User requests the deletion of their personal data.

Notwithstanding the foregoing, information may be retained to comply with legal or regulatory obligations; transferred to third parties, provided that all applicable data processing requirements are observed; or retained as necessary to fulfill the purposes for which it was collected, perform a contract, comply with legal obligations, or exercise legal rights.

  • Confirmation of the existence of data processing;
  • Access to personal data;
  • Correction of incomplete, inaccurate, or outdated data;
  • Anonymization, blocking, or deletion of unnecessary or excessive data or data processed in violation of applicable regulations;
  • Portability of personal data to another service or product provider, upon the User’s express request;
  • Deletion of personal data processed with the User’s consent;
  • Information about the public or private entities with which LMG has shared the User’s personal data;
  • Information about the possibility of withholding consent and the consequences of doing so;
  • Withdrawal of consent.

Some of these rights may be exercised directly by the User through the management of their account information, while others will require the submission of a request for subsequent review and appropriate action by LMG.

The User acknowledges that deleting information essential to managing their account with LMG may result in the termination of their registration and the consequent cancellation of the services being provided.

LMG will make every reasonable effort to respond to such requests as quickly as possible, always in compliance with applicable law. In some cases, deletion requests may not be fulfilled immediately due to legal requirements.

12. RESTRICTIONS ON USE

You may save content from the pages of this website on your computer or print it, provided that it is used solely for personal purposes. Except as expressly permitted above, copying, reproducing, transferring, publishing, or distributing, in whole or in part, any content, trademarks, or logos displayed on this website without LMG’s prior authorization is prohibited under applicable copyright laws.

13. CHANGES TO THE PRIVACY POLICY

14. GOVERNING LAW AND JURISDICTION

This Policy shall be governed by, construed, and enforced in accordance with the laws of the Federative Republic of Brazil, particularly Law No. 13,709/2018, regardless of the laws of any other state or country. The courts located in the User’s place of residence shall have jurisdiction to resolve any disputes arising from this document.
